Rahul Gandhi Defamation Case: The Supreme Court sought answers from former Gujarat minister Purnesh Modi and the state government on Friday (July 21) on the petition of Congress leader Rahul Gandhi in the defamation case related to Modi surname. A bench of Justices BR Gavai and PK Mishra said that the matter would be heard next on August 4.

The Gujarat High Court had rejected the petition filed by former Congress President Rahul Gandhi in the case, in which his conviction (sentence of two years) was requested to be stayed. It was for this that Rahul Gandhi approached the Supreme Court. Meanwhile, Justice BR Gavai asked during the hearing whether any party has any objection to my hearing?

Justice BR Gavai mentions his father and brother
Justice Gavai told advocate Mahesh Jethmalani, appearing for Rahul Gandhi’s advocates Abhishek Manu Singhvi and Purnesh Modi, that his late father RS Gavai may not have been a member of the Congress, but he was associated with the party for more than 40 years and was elected as a Member of Parliament and MLA with its support.

He said that his brother is also a leader. He is still associated with the Congress. In such a situation, he asked, “If anyone has any problem with my (family) background, please tell me.” Singhvi and Jethmalani said that they know it. He has no objection to Justice Gavai hearing the matter.

What is the matter?
Rahul Gandhi had remarked during an election rally in Kolar, Karnataka in 2019 that ‘‘Why do all thieves have the same surname Modi?’’ On this, Purnesh Modi, a former Gujarat government minister, filed a criminal defamation case against Gandhi in 2019.
