In Indian politics, it is not a big deal for a leader to be a criminal, rather it has been accepted that no principled person can do politics. There are many big leaders in this country on whom cases ranging from kidnapping to murder are going on.
Actually, according to a condition of the Supreme Court, before becoming an MLA, any leader has to file a self-declared affidavit, in which details of how many criminal cases have been registered against him are given. According to this affidavit, 44 percent of the total MLAs in India have criminal cases.
Some of the charges against politicians were minor or political, but most of the legislators were charged with serious charges such as attempt to murder, assault on government officials, and theft.
At present there are total 4001 MLAs in our country. Out of which 1,777 i.e. 44 percent leaders have been involved in crimes like murder, rape, kidnapping. At the same time, 43 percent of MPs in the present Lok Sabha are involved in criminal cases.
23 years ago, ie in 2004, this number was 22 percent, which has now doubled. This figure shows that despite lakhs of efforts to make politics crime-free, the number of MLAs and MPs against whom criminal cases are pending is increasing.
Enquiry completed but verdict not delivered
It is to be noted here that these 1,777 leaders facing criminal cases do not have any minor charges. These are the cases in which the investigation has been completed and the police has also filed the charge sheet in the court, but despite this, no decision has been pronounced on these cases.
Most of the leaders with criminal cases are not worried about the decisions of the courts, because till the court does not pronounce the decision of being found guilty, no one can stop these leaders from contesting elections, even while in jail. Can also be contested.
According to the government report, Madhya Pradesh along with Telangana and Andhra Pradesh are the three states in which not a single case has been settled in the last 5 years.
What the figures say
If we look at the serious criminal cases against these MLAs, 1,136 or 28% of the total criminal case MLAs are in cases where the accused can be sentenced to five years or more in jail if found guilty. p>
According to the data received from ADR, 47 MLAs have cases of murder, 181 cases of attempt to murder and 114 cases related to crime against women. 14 MLAs have been booked for rape.
MLAs of these states have been booked for serious crimes
- 53% of Delhi MLAs have serious criminal cases registered against them
- 59 percent of the MLAs of Bihar have criminal cases registered for serious crimes.
- Maharashtra, Jharkhand and Telangana account for 39 per cent of similar cases.
- 38% sitting MLAs in Uttar Pradesh have serious criminal cases against them.
Which party has how many such dignitaries
Bharatiya Janata Party – BJP has government in 15 states of India. In these, BJP is running the government in 6 states with majority and in 9 states with allies. The BJP has a total of 479 MLAs in these states, out of which 337 MLAs have serious criminal cases registered against them. Currently, maximum number of BJP MLAs have criminal cases registered against them.
Congress- Congress ranks second in the list of MLAs with criminal cases. 334 Congress MLAs have criminal cases against them, out of which 194 MLAs have serious criminal cases against them.
Other parties- Other parties include Dravida Munnetra Kazhagam (DMK), Trinamool Congress, Aam Aadmi Party, YSR Congress, Samajwadi Party, Bharat Rashtra Samithi (formerly Telangana Rashtra Samithi), Rashtriya Janata Dal, Indian Communist Party (Marxist) and Biju Janata. The number of MLAs in these parties is less, but the percentage of crime is high.
Pending cases increasing year on year
- According to the data released in the month of December 2018, there were 4122 criminal cases pending against MPs and MLAs. Out of which 1675 are MPs (former and present) and 2324 are MLAs (former and present).
- According to the data released in the year 2021 of December, the pending cases were 4984 this year. This means that the cases against the leaders are increasing day by day. The total number of cases pending for the last five years in December 2021 was 1899.
- According to the data of November 2022, the number of cases pending more than 5 years was 962, although this data did not include the data of 9 high courts of the country.
- According to the data received from 16 High Courts of the country on 12 November 2022, 3069 cases were pending against MLAs and MPs. That is, the figures of other 9 High Courts of the country including UP Bihar are not included in this.
Criminal leaders get more votes
In a BBC report, Dr. Vaishnav, Senior Fellow at the Carnegie Endowment for International Peace, has told about his research. He studied all the candidates standing in the three general elections. After which they divided the candidates with clean records and the candidates with criminal records separately and found that candidates with criminal records have 18 percent chance of winning the next election. Whereas "Candidates with a clean image have only 6 percent chance of winning the election.
He did a similar calculation of the candidates who contested in the assembly elections between 2003 and 2009, according to which "Candidates against whom cases are pending got more advantage of victory".
