Advocate Murari Tiwari said that in such cases, if the victim’s statement is overturned, there is a lot of impact on the case. In such cases, the accused gets an advantage because the statements of the victim are doubted. The lawyer of the accused can take advantage of this in the court.
The lawyer further said, however, the Magistrate in front of whom the statement of 164 is recorded usually does not hear the entire case. The police make the victim’s statement a part of their charge sheet by recording it in front of the magistrate, then the court in front of which the entire case is heard decides whether to accept the withdrawn 164 statement or not.
