Rahul Gandhi Defamation Case: The Gujarat High Court on Friday (July 7) dismissed the petition of Congress leader Rahul Gandhi in the defamation case related to Modi surname. The court said that the decision of the lower court with a sentence of two years is correct. With this, the rhetoric between Congress and BJP has intensified.
On one side Congress is saying that Rahul Gandhi is fighting the battle of truth. Because of this they are being intimidated, while on the other hand BJP is saying that Rahul Gandhi had given an insulting statement. Big things-
1. Former Congress President Rahul Gandhi in 2019 Lok Sabha elections he allegedly said in Kolar, Karnataka ‘‘Why do all thieves have the same surname Modi?’’ BJP leader Purnesh Modi had filed a criminal defamation case against him for this comment. On March 23, the Metropolitan Magistrate Court of Surat convicted Rahul Gandhi under sections 499 and 500 (criminal defamation) of the Indian Penal Code (IPC) and sentenced him to two years in jail. After this, Rahul Gandhi was disqualified from the membership of Parliament. He was elected to the Lok Sabha in 2019 from Wayanad, Kerala.
2. On the decision of the Gujarat High Court, the Congress said that it will approach the Supreme Court. Congress leader KC Venugopal tweeted that we will study the decision of the Gujarat High Court. Will look into all legal options. Rahul Gandhi is the fearless voice who besieges the Modi government. 5. On behalf of the Congress, Abhishek Mun Singhvi said in a press conference that the decision of the Gujarat High Court is disappointing, but we expected the same. He said that this matter is not only of Rahul Gandhi or any particular person. It is a matter of expression. The aim of this government is to control the freedom of expression. This is the reason why the government has misused the law of defamation. Singhvi said that this is a conspiracy against Rahul Gandhi. Its purpose is to stifle free thought and conversation. By doing this, they think that this type of independent thinking should be suppressed. He reiterated that we will go to the Supreme Court.
6. News agency PTI quoted sources as saying that the Congress party will file a petition in the Supreme Court in Rahul Gandhi’s case before the monsoon session of Parliament begins on July 20. On the other hand, on July 12, the Congress will protest across the country on the whole issue.
7. On behalf of the BJP, former Union Minister Ravi Shankar Prasad said in a press conference that the decision of the Gujarat High Court is welcome. If Rahul Gandhi considers it his right to humiliate people, then there is a law which will deal with him. The person who is insulted also has the right to approach the court for justice.
8. BJP leader Ravi Shankar Prasad further said that Rahul Gandhi has no control over his speech. Let’s say anything. The court had also given him a chance to apologise, but he refused. This is his ego. Now sponsored comments can come from the Congress as to why the court took such a decision? So our answer is why did Rahul Gandhi do this?
9. Ravi Shankar Prasad said that we want to ask the Congress that why can’t you control Rahul Gandhi? Why can’t you train them to speak properly? He said that most of the backward and extremely backward people have the surname Modi in the country. This was a very offensive comment. The lower court sentenced him to 2 years. Against this he went to the sessions court. The sessions court granted him bail but did not stay the sentence. Against this he went to the Gujarat High Court and his effort was to stay his sentence.
10. At the same time, the lawyer of Purnesh Modi, who filed the petition, said that from what the court said while giving the verdict, we understand that the decision of the lower court is correct. No one can get special benefit because of being MLA or MP. There are many such cases against the accused.
